Customer Relations Information;

Return Policy and Payment System

1. After ordering the product, the buyer transfers the product price to the secure pool account in the bank managed by tarimspot. The seller is notified by tarimspot that the product has been sold and the price paid by the buyer.

2. The seller sends the product to the buyer's address within 3 (three) days after the buyer pays to the Secure Pool Account and ensures that the shipping information is entered on the site. The buyer, who receives the delivered product, confirms on the site that the product complies with the qualifications and conditions specified on the site, within 3 (three) days + 24 hours after the product is shipped, and thus approves the transfer of the product price to the seller's TARIMSPOT PARA account. Products that are not approved within this period or that do not have a return request are processed automatically as approved, and the product price is transferred to the TARIMSPOT PARA account of the Seller by deducting the commission of tarimspot 3 working days after the approval process. After 3 working days after the Seller's request to transfer the money in TARIMSPOT PARA account to his own bank account, the money transfer / eft transaction is carried out.

3. If the Buyer does not accept the Product sent to him by the Seller because it does not comply with the information and/or photos specified by the Seller on the tarimspot site, he/she shall return the Product to the Seller and request a transaction to the tarimspot for the return of the Product price. accepts, declares and undertakes. The buyer may request a return for the product in any of the following situations.

               Damaged product

  • Wrong product

  • Missing shipped products

  • Replica or imitation products

In the event that the product received by the buyer is clearly different from the one shown and/or described on the site, he/she should contact our support team at info@tarimspot.com within 3 days + 24 hours at the latest and share a photograph and a detailed description of the product to be returned, stating the reason for the return. . After the examinations, if the declaration is confirmed, the product is requested to be shipped back to the seller's address within 3 days, and the sales price of the relevant Product is kept in the tarimspot Secure Account within 3 days + 24 hours after the product is shipped back to the seller, to the Buyer's account. accepts, declares and undertakes that it will be sent back. Return shipping fee is the responsibility of the buyer.

4. After receiving the returned product, the Buyer declares through our system that the product has been received in full within 3 days. If no declaration is made within 3 days, the return will be deemed to have been accepted automatically and the fee paid by the buyer will be transferred back to the same account in the same way and by which method it was paid. Refunds for returns are made on Monday, or the first business day following if it is a holiday. A 5% service fee is deducted from returns.

4. If the seller does not ship the product within 3 days after the sale price is paid and deliver the product to the buyer, the product/service price is returned to the buyer from the secure pool account.

5. If the buyer does not give a confirmation or return notification within 3 (three) days + 24 hours after the product is shipped, the product is automatically accepted as approved, the product price is transferred to the TARIMSPOT PARA account of the Seller by deducting the commission of tarimspot 3 working days after the confirmation. After 3 working days after the seller's request from tarimspot to transfer the money in TARIMSPOT PARA account to his own bank account, the money transfer / eft transaction is carried out.

6. In the event of a dispute between the buyer and the seller, tarimspot has the right to block the product price in the safe pool account until the parties reach a settlement or a court/arbitration committee decision is taken.

In order to ensure the functioning of the Iyzivo Payment System defined in this user agreement, the Intermediary Service Provider appoints the seller as the representative exclusively for the collection of the prices for the products offered for sale from the Buyer on its own behalf and account. The Buyer shall fulfill its payment obligation under the purchase and sale contract by making the payment for the products to tarimspot as the Seller's representative. In case the above-mentioned representation authority is canceled by the Seller, tarimspot has the right to terminate the user agreement and cancel the Seller's membership.

Users are responsible for all kinds of taxes, duties, fees and similar liabilities that may arise from the sale or transactions related to the sale of products bought and sold using the Iyzico Payment System and tarimspot services.

Privacy and Terms of Use

Article 1 - Introduction

This user agreement ("agreement") and other rules on www.tarimspot.com and/or tarimspot mobile applications (¨site¨) regulate the terms and conditions of the services offered by tarimspot. All the policies and rules on the site are an integral part of this contract and form an annex to this contract.

 

This contract is with you, Karşıyaka Mah. Yildirim Beyazit cad. It is made between tarimspot located at the address No:30/4. By using our services, you accept the terms and conditions of this agreement.

 

Article 2 - Duration

 

Membership registration is completed by entering the required identification information into the application and confirming the e-mail to be sent to the e-mail address provided by you. This agreement will enter into force on 06.08.2017 for existing users and on the date of registration for new users and will remain in effect until terminated. 

 

Article 3 - Scope

 

tarimspot provides you with a virtual marketplace that allows you to sell and/or buy products and/or services over the internet. tarimspot is not the owner or seller of the products and/or services listed on this site.

 

tarimspot does not make any representations, guarantees or commitments regarding the accuracy, quality, safety of the content provided by users and the products and services offered for sale, or whether these products and / or services are legal.

 

Article 4 - Services

 

The services provided by tarimspot briefly; 

 

1. Virtual Marketplace 

a. It is to provide a platform to sellers where they can offer their products and/or services for sale by creating their own content, and to buyers where they can view and order many products and/or services in different categories. 

b. Sellers and buyers can communicate about the sales price, delivery conditions and payment terms of the product and/or service by using the site infrastructure and can reach an agreement on the order conditions. 

 

2. 100% Secure Shopping System 

a. Tarimspot, which is not a party to the sales contract, provides a 100% Secure Shopping System to the buyer and seller at the payment stage of the buying and selling process. Failure to collect the price in return for the delivery of the goods to the seller; It aims to protect the buyer against the risk of not delivering the goods at all or under the desired quality and conditions in return for the payment of the price. 

b. The secure account, which is kept under control and managed by tarimspot within the scope of the 100% Safe Shopping System, is operated in accordance with the 100% Safe Shopping System rules included in this contract and its annex. 

c. The functioning of the 100% Secure Shopping System is as follows: 

I. After the buyer orders the product and/or service, he transfers the product and/or service price to the secure account at the bank managed by tarimspot, and the Seller is notified that the product and/or service price has been deposited into the secure account. 

ii. The seller sends the product and/or service to the buyer's address within 3 (three) business days (+ an additional 24 hours) after the buyer pays to the Secure Account and enters the shipping information into the application. The buyer, who receives the product and/or service sent, approves the transfer of the product and/or service price to the seller's bank account through the application, if the product/service complies with the agreed qualifications and conditions. 

iii. If the seller does not provide the delivery / performance of the product and / or service to the buyer, or if it is determined that the product and / or service sent by the buyer does not meet the specified qualifications, or if the buyer refuses to purchase the product and / or service, the product / service fee will be returned to the buyer from the secure account. . 

iv. If the buyer does not approve or return notification within 3 (three) business days (additional 24 hours) after the seller enters the cargo information of the product or the information regarding the performance of the service, the product and / or service fee is automatically transferred to the account of the seller. For this purpose, after the completion of 3 (three) business days, a reminder message will be sent to the recipient's e-mail account by tarimspot. If the buyer does not submit his/her complaint regarding the product and/or service on the site within the following 24 hours, based on this e-mail message, the product and/or service fee will be transferred to the seller. 

v. In the event of a dispute between the buyer and the seller, tarimspot has the right to block the price of the product and / or service in the secure account until the parties reach a settlement or a court / arbitral tribunal decision is taken. 

D. Users are liable for all kinds of taxes, duties, fees and similar liabilities arising from the sale of products and/or services bought and sold by using the 100% Safe Shopping System and tarimspot services, or any kind of tax, fund, penalty, in case of importation of the product, are responsible for other liability. 

 

Article 5 - Terms of Use

 

When you enter the site and/or use tarimspot services, the following actions will be deemed to be in clear violation of the contract:

 

1. Listing products, services and content in the wrong category,

 

2. Violation of legislation, violation of the rights of third parties and/or this contract or its annexes,

 

3. Sale of counterfeit products or violation of intellectual and/or industrial property rights such as copyright, trademark, etc. of third parties,

 

4. Not having the capacity to take legal action (such as being under the age of 18) or using tarimspot services even though you are banned from membership,

 

5. Failure to deliver/perform the products and/or services or not pay the price of the purchased product and/or service,

 

6. Manipulating prices or interfering with other users' listings,

 

7. Deceptive, misleading, incomplete, wrong content placement,

 

8. transfer of user account or name without the written consent of tarimspot,

 

9. Spamming, unsolicited or mass electronic communication or sending chain e-mails,

 

10. distribution, dissemination of viruses or technologies that may harm tarimspot or its users,

 

11. Damage to tarimspot infrastructure, system, including behaviors intended to disrupt the user profile evaluation system,

 

12. Entering the site with robot or automatic entry methods for any purpose,

 

13. Collecting and storing users' e-mail or other personal information without the prior written consent of the users,

 

14. Resale, sharing, distribution, reproduction of any part of the site (including but not limited to design, text, image, html code and other codes) that is the subject of intellectual and / or industrial property, making derivative works of them.

 

If you are a member of the site as a legal entity, you represent and warrant that you are authorized to represent and bind the relevant legal entity. Otherwise, you agree to be personally liable for any debts and liabilities arising.

 

By becoming a party to this agreement, you agree that tarimspot can monitor and process all kinds of communication between users and their content through the site, and that it can keep and store the records of this content for at least 3 years in accordance with the legal legislation and give it to the relevant parties when necessary within the scope of the legislation. 

 

Article 6 - Conditions of Sale

 

When you list products and/or services, you agree that you, as a seller, will act in accordance with the following conditions and "Rules for Sellers": 

 

1. You agree that you will deliver/perform the product and/or service on time, in accordance with the qualifications you have specified on the site, and without any defects. 

2. You will comply with all regulations regarding the protection of the consumer, including the Law on the Protection of the Consumer, the Regulation on Distance Sales, and that you will be the addressee of all rights and obligations of the buyers arising from the consumer law, and that you will meet the demands of the buyer and the damage and loss to be incurred, to the developments to be made on the site in accordance with the consumer law, and You agree that you will act in accordance with the rules. 

3. As a seller; 

a. You are authorized to list the products and / or services on the site and offer them for sale, that the ownership of the products you list or the right to offer for sale belongs to you,  

b. that you put the products and/or services on the market and/or sell and/or import in accordance with the legislation, that there are no obstacles to the publication, sale and sale of these products and services on the internet, that they are original, have not been altered or deteriorated, 

c. You are authorized to use the logo, brand and other content related to the products and/or services and to grant the license contained in this agreement, 

D. Processing, reproduction, dissemination, representation and sign, TV channels, internet, as stipulated in the Law on Intellectual and Artistic Works and other relevant laws, regarding the content required for promotion, including the logo, brand, technical specifications, images, price information regarding products and/or services. broadcasting and rebroadcasting by means of wire or non-wire broadcasting organizations such as radio-television, satellite and cable, including promotional channels, or by means of signal, sound and / or image transmission, including digital transmission; communicating to the public and making it available to third parties via digital media, including the Internet; Regarding the rights of transmitting to the public and making it accessible to third parties through smart device applications and/or in various forms on mobile devices/environments and technologies known at the date of this contract and/or to be developed after the contract date, without being subject to any location, content and number limitations at home and abroad. You are granting Zebramo a non-exclusive free license valid for the term of the contract, 

to. that the products and/or services have invoices, warranty documents and all kinds of tax liabilities including customs duties regarding the products are fulfilled, 

f. You agree that you will comply with all applicable or future legal regulations, especially tax, customs, export, import, consumer protection, competition, advertising, intellectual and industrial rights legislation. 

4. In line with the minimum price you specified when listing the product, you agree to act in accordance with the rules determined by tarimspot in the sales made with a pricing model similar to the price change (automatically cheaper of the product price) within the period determined algorithmically by tarimspot. 

5. In cases where you violate this contract and/or legal regulations, you agree that you will be responsible for fulfilling the transactions requested by tarimspot and taking the actions regarding the transaction or action subject to the violation. 

6. As the seller, you agree that if you have a third party supplier perform any of the transactions made through the user account on the site, you are responsible with the supplier for the transactions made by your supplier through the application against tarimspot. 

 

Article 7 - Listing

 

You agree to act in accordance with the Listing Rules in the appendix while offering the product and/or service for sale.

 

1. You agree that you are responsible for keeping the listed products and/or services up-to-date and legal, and for the content or listing of products and/or services that are subject to legal restrictions in accordance with these legal restrictions in the offering for sale.

 

2. Products and/or services that are on the list of prohibited products and/or services or whose sale is prohibited or will become prohibited in the future cannot be offered for sale.

 

Article 8 - Fees

 

Fees for listing are announced in the "Rules for Seller" section. tarimspot may change its pricing policy and fees from time to time with the announcements it will make 30 days in advance or the messages it will send. Users who do not accept this change will be able to leave the membership within 30 days without compensation and penalty.

 

Article 9 - Conditions of Purchase

 

Before you buy a product, learning the rules and processes of tarimspot will prevent you from unwittingly breaking the rules. Remember that as a tarimspot user, you have to follow the site rules constantly. 

 

tarimspot rules; It exists to minimize the problems that users may encounter, to provide equal opportunities, and to make your shopping fun. Violation of these rules may result in restriction of your listing and purchasing rights and suspension of your membership. 

 

If the criteria specified by the seller on the product page do not suit you and / or you think that there is misleading information about the product, do not buy that product. Making a payment for an item you don't want to buy in order to sabotage the seller's sale is called a "malicious purchase." Your membership will be restricted when it is detected that you have carried out similar actions. 

 

Contacting a seller to make transactions outside of tarimspot and offering them to perform transactions outside the site is a violation of the rule and requires cancellation of membership. 

 

Article 10 - Intellectual Property

 

All content created by tarimspot on the site, including but not limited to the design of the application and/or zebramo.com site, image, html code, and the tarimspot brand and logo belong to tarimspot. Users cannot use, share, distribute, exhibit, reproduce, or create derivative works from tarimspot's intellectual property rights.

 

Article 11 - Rights of agrispot

 

As a user, tarimspot is not responsible for any legal proceedings, investigations or lawsuits directed to tarimspot regarding the products and/or services offered for sale or the transactions you will perform on the site, and all information and documents necessary for tarimspota to defend itself. You agree to provide as soon as possible. In case of warning from third parties or any violations are detected, tarimspot has the right to remove the relevant content from the site. Due to tarimspot's removal of the said products and/or services from the site, no compensation obligation will arise against the seller.

 

Membership of the seller, who is found to be offering the prohibited products specified in the contract and products prohibited by the relevant legislation, and/or does not comply with the contract provisions and the rules specified on the site, may be suspended or canceled by tarimspot.

 

As a user, in cases where the buyer does not give an approval and/or return notification or the seller does not request the sending of the confirmation reminder message, tarimspot is responsible for the product and/or delivery information within 15 days after the seller enters the cargo/delivery information for the product and/or service. you agree that the service fee will be transferred to the seller's account 

 

Article 12 - Termination

 

Any of the parties can unilaterally terminate this contract and its annexes at any time. In such a termination, the parties shall mutually perform the rights and obligations arising up to the date of termination. tarimspot will be able to terminate the contract and your membership unilaterally immediately if you violate this contract and its annexes. In this case, you agree that you are responsible for all damages and losses incurred/incurred by the agrispot.

 

Article 13 - Responsibilities

 

You may incur material/moral, direct/indirect damages and all costs (litigation expenses and attorneys' fees, etc.) You hereby irrevocably agree to pay all the payments made, especially indemnity and administrative fines, in cash and all together with all its accessories, within 7 (seven) days following the first written request of tarimspot, without prejudice to the judgment of any legal authority.

 

If tarimspot wishes, Iyzico has the right to deduct these fees from the balance in the secure account or to block these fees.

 

Tarimspot's liability arising from this contract is limited to the sum of the fees and commissions, if any, collected by Tarimspot from the user as of the date of the event causing the damage, under this contract, excluding cases of intent and gross negligence.

 

Article 14 - General

 

1. Neither party shall be liable to the other party for non-fulfillment or delay of any obligation undertaken under this contract due to force majeure. Force majeure is any unforeseen and unavoidable event that is beyond the reasonable control of the parties. Public uprising, war, government restrictions and administrative decisions, embargo, enforcement of the government or an institution, internet speed and interruptions, natural disaster, storm, fires, accident, sabotage, explosion, terrorist attack, supplies or consumables, but not limited to the following material shortage, strike and lockout are considered force majeure. 

2. Except for the transfers that tarimspot will make to their own group companies, the parties shall not transfer their rights and obligations arising from this contract to any third party. 

3. All notifications to be made with you will be made in electronic form through advertisements or in writing to your e-mail address or physical address that you have specified in the system. If you do not notify any e-mail or address change in writing or update it on the site, the notification to your current e-mail address or physical address will be considered valid. 

4. Users accept that they will receive e-mail and/or push notifications that can be sent by tarimspot regarding shopping, sales, likes, comments and similar topics.

5. tarimspot can only use information about users in accordance with the regulations in the Privacy Policy. 

6. tarimspot can change this agreement at any time by publishing the updated articles on www.tarimspot.com via e-mail or  in the application. 

7. Policies and rules in our application may be changed from time to time. Changes will be valid on the date they are published on the tarimspot site or in the application. 

8. Turkish Law will be applied in the settlement of legal disputes arising from the implementation and interpretation of this contract. Bursa Courts (Center) and Enforcement Offices will be authorized in the settlement of all disputes that may arise between the parties due to the interpretation or application of the provisions of this contract. 

9. The parties accept that the books and records, computer records, confirmed fax messages and e-mails of the parties will constitute valid, binding and evidence in disputes that may arise from this contract. 

10. If any provision of this agreement is held by a court or other competent authority to be wholly or partially invalid or unenforceable, the validity of the other provisions of this agreement and the remainder of such provision shall not be affected. 

11. The fact that tarimspot does not use any of its rights or uses it late will not mean that it has waived this right. 

12. Nothing in this agreement shall be construed as any representation, agency, partnership or any other kind of joint venture (joint venture etc.) relationship between the parties. 

 

Article 15 - Annexes

 

Users accept that the rules and policies published in the application or on the www.tarimspot.com site are an annex and an integral part of this agreement.   

 

Payment services on tarimspot are provided by İyzi Technology and Payment Systems Anonim Şirketi (İYZİ). By accepting this agreement, you also agree to the following Virtual Platform Usage Framework Agreement.

 

 

 

VIRTUAL PLATFORM USE FRAMEWORK AGREEMENT

 

1. PARTIES

 

This Virtual Platform Usage Framework Agreement has been concluded between iyzico, whose information is given below, and the USER who wishes to benefit from the services in this Agreement.

The natural or legal person who benefits from the services in this Agreement as Buyer or Seller (Buyer and Seller together will be referred to as USER)

Card, mobile phone, password and similar personal tool used by the buyer to give the payment order

 

Payment Account

 

The account opened at iyzico on behalf of the USER and used for the execution of the payment transaction

 

Payment Process

 

A series of operations carried out through the Platform in order to pay for products or services offered for sale on the Website.

 

Platform

 

Virtual platform consisting of software with a virtual payment and verification gateway developed by iyzi

 

marketplace

 

The company that operates the Website.

 

Sales person

 

USER who makes sales through the Website, to whom the fund subject to the Payment Transaction is requested to reach

 

Service

 

The iyzicollect service to be offered to the USER within the framework of the terms and conditions determined in the Contract

 

System Partner

 

The bank or financial institution that cooperates in the processing of payments through the platform

 

Agreement

 

This Virtual Platform Usage Framework Agreement concluded with the USER

 

Suspicious Transaction

 

Payment Transaction that may be considered as Erroneous/Unauthorized Transaction, including in the cases determined by the contract

 

Authorized Personnel

 

Personnel authorized by iyzico to support and communicate with the Seller about the use of the Platform

 

Management Interface

 

Management interface for the Platform, which enables the Seller to make settings regarding the Platform, change contact information and perform other operations within the scope of the Agreement.

 

3. SUBJECT OF THE AGREEMENT

 

Payment services are provided by iyzico in the virtual marketplace operated by the Marketplace on the Internet Site. In this context, iyzico will provide payment services to both the Seller and the Buyer in accordance with the Law No. 6493 on Payment and Securities Settlement Systems, Payment Services and Electronic Money Institutions (“Law”). shall transfer the amounts kept in the Buyer's Payment Account to the Seller's Payment Account following the approval, until the approval as specified in this Agreement regarding the full and proper delivery of the goods or services provided to the Buyer.

 

This Agreement is governed by the principles regarding the Service offered by iyzico to the Seller for the collection of the prices of the products and services offered for sale through the Website, and for the Buyer to transfer the prices of the products and services purchased through the Website to the Seller, within the scope specified above. It regulates the rights and obligations of the Parties within this scope.

 

4. GENERAL CONDITIONS

 

4.1. RECORD

 

a) Once the Marketplace transmits the USER information to iyzi via the API, iyzi will register the USER to the service.

 

b) Following iyzi's approval of the USER information, this Agreement will become effective and valid as of the date the Agreement is approved by the USER.

 

4.2. TERMS OF USE

 

a) The USER will be able to use the Service only after the Agreement enters into force.

 

b) iyzi reserves its rights in the following matters:

 

- Calling the USER by phone before the contract enters into force and verifying the information transmitted by the Marketplace, requesting additional information and documents; and/or,

 

- Not registering the USER without giving any reason.

 

4.3. PRINCIPLES OF PLATFORM WORKING PRINCIPLES

 

4.3.1 General Principles

 

a) Pursuant to this Agreement, iyzico accepts and undertakes to provide Services for the purpose of accepting and processing the payments for the products and services ordered by the Buyer from the Website and making the payments to the Seller.

 

b) The USER accepts and declares that he is obliged to use the Platform in accordance with the instructions of iyzico and update it when necessary so that the Platform can be used correctly and effectively. iyzico does not have any responsibility in case of failure to provide efficiency from the Platform or any errors in transactions due to violation of this article.

 

c) iyzico will make its best efforts to keep the Platform at the required security level in order to prevent access to information by unauthorized persons. In this sense, the USER will provide maximum support to iyzi and act in accordance with iyzi's instructions.

 

d) iyzi reserves the right to change the security standard, especially as a result of security standard changes made by System Partners.

 

e) The USER declares that he/she knows that the provisions for the payments made by the Buyer are made within the scope of the conditions specified by the System Partners, and that iyzico is not responsible for any breaches or attacks (hacking, phishing) against the websites of the System Partners.

 

f) The Platform and the services within the scope of the Agreement can be used exclusively by the USER. Violation of this provision constitutes a violation of the Agreement and this violation will be sufficient reason for the unilateral termination of the Agreement by iyzico.

 

d) The platform will only be used by the USER in relation to the transactions performed by the USER on the Website.

 

e) The Seller keeps the password that allows access to the Management Interface and the Buyer to the Platform and/or the information he/she provides regarding the Payment Instrument (if any) confidential, not to disclose it to unauthorized persons, and to prevent the use of these passwords for purposes other than the allocation purpose. liable. The Buyer is also obliged to immediately notify iyzico through one of the methods specified in this Agreement, in case of loss, theft or unauthorized use of the aforementioned information or the information of the Payment Instrument. iyzi does not have any responsibility in case of loss or disclosure of such information by the USER, nor is it liable for any damages caused to the USER by third parties unless it is proven that the fault belongs to iyzi. In case of loss of the password, the USER will immediately notify iyzi in writing of this situation and iyzi will take the necessary actions to prevent the use of the password in question, inform the USER of this situation and give the USER a new password as soon as possible. In case the identity identifier specified by the USER is incorrect, iyzico cannot be held responsible for the non-execution of the Payment Transaction or its erroneous execution.

 

f) The USER shall be liable to the extent of his own fault for provably unauthorized use of the Platform or an administrative account or unauthorized access to the administrative account.

 

4.3.2 Additional Regulations Regarding the Seller's Use of the Platform

 

a) In case the Seller wishes to benefit from the Service through its own website or other websites, this matter will be notified separately to iyzi and, if iyzi accepts, a separate agreement will be concluded between the Parties regarding the subject. In case the Seller's field of activity is changed, iyzi will immediately be notified of such change in writing, and iyzi may terminate or suspend the service provided without further notice, if it is determined by iyzi that the new activity or content does not comply with iyzi standards. b) iyzico will ensure that the system tools necessary for using the Platform are put into practice by the Seller.

 

c) iyzico will provide usage support for the Platform and has the authority to give instructions regarding the installation, use and operation of the Platform.

 

d) The Seller shall immediately inform iyzico in writing in case of cyber attacks, viruses and similar harmful and unauthorized accesses to the Platform and information by third parties.

 

e) iyzico does not allow the Seller to make changes to the system tools, interfere with their functions other than those stipulated by the system, or act contrary to the installation and usage instructions of the system tools. The Seller's violation of these matters constitutes a violation of the Contract.

 

f) The Seller is obliged to present the information required to be submitted in accordance with the legislation in force, in particular the information below, in the area allocated to it on the Website:

 

- Detailed descriptions of the products and services offered through the Website,

 

- Product return and payment refund policy,

 

- Seller's contact information, including e-mail address and phone number, for USER service needs,

b) The USER will comply with the explanation regarding the Platform features offered by iyzi and the “Rules for Payment via the iyzi Platform” and all updates related thereto, and will be responsible for any requests that may arise due to non-compliance.

 

c) The Seller shall not offer illegal products and services on the Website. iyzi has the authority to completely or partially stop the use of the Platform, in case it is determined that the products or services listed below are offered on the Internet Site, the sale of which is illegal or contrary to the principles of iyzi. Likewise, the Buyer shall not use the Service and Platform to provide illegal or immoral products and services and/or for illegal or immoral purposes. e) Rejecting the Payment Transaction or suspending the access to the Platform due to the reasons listed above does not constitute a breach of the Agreement by iyzico.

 

f) All responsibility that may arise due to the above-mentioned issues belongs to the USER, and iyzi's right of recourse to the USER, together with its accessories, is reserved. In the event that iyzi suffers a loss as a result of the sale or supply of products and services, the sale or supply of which is against the law or contrary to iyzi's principles, the USER is obliged to indemnify iyzi for all kinds of damages.

 

g) The USER is obliged to provide information to iyzico, upon request, regarding the products or services offered/provided on the Website and the transactions within the scope of the Service. j) The Buyer shall take all reasonable measures necessary to keep the Payment Instrument secure. In case of loss, theft or unfair use of the Payment Instrument, the Buyer shall immediately notify iyzico through one of the communication ways specified in this Agreement.

 

k) The USER will take the necessary measures to ensure the confidentiality and security of Sensitive Payment Data. The Seller shall not keep, process or record Sensitive Payment Data on its own, and shall immediately notify iyzico in case of important security incidents.

 

l) The Seller accepts, declares and undertakes that he/she will not engage in any transactions that constitute a beneficial cash sale to themselves or to third parties by making transactions on the Internet Site in a way that does not comply with their real will through virtual POS devices in order to earn profits by using a payment card belonging to them or a third party. In the event that a transaction is detected by iyzico or official authorities, iyzi has the right to stop the use of virtual POSs that will be effective unilaterally and immediately, and to terminate the Agreement due to breach of contract. 6. RIGHTS AND OBLIGATIONS OF iyzi

 

6.1. iyzi's Right to Block Access to the Platform or Administrative Interface

 

a) iyzico shall have the right to block access to the Platform or the Management Interface, especially in the event of the following situations. Access will be restored after the aforementioned situation is eliminated. If access is blocked, the USER will not be able to use any features (return, reporting, USER creation, etc.) available on the Platform or Management Interface.

 

- If there is a computer virus threat to the Platform,

 

- If the USER does not provide the information requested from him within the scope of this Agreement (including the information that must be submitted by the Seller to the Buyer),

 

- If it is determined that the Service is used in violation of Article 5(c),

 

b) If the situations listed in subparagraph (a) of this article are not corrected by the USER within 3 days or if such situations repeat more than once within 2 months, iyzico has the right to suspend access to the Platform. When the reason for the suspension of the Platform is eliminated, IYZI opens the Platform for use again after the security audit.

 

c) iyzi has the authority to audit the services related to this Agreement without prior notice to the USER.

 

6.2. Platform Maintenance, Outages and Troubleshooting

 

a) iyzi will provide the continuous maintenance, equipment and technical support necessary for the smooth operation of the Platform. In connection with this, iyzico reserves the right to temporarily suspend or limit the operation of the relevant servers in cases expressly stated in this Agreement. In this case, the USER is not entitled to any compensation.

 

b) Except for the cases expressly stated in this Agreement, iyzico will take the utmost care to make any interruptions for necessary maintenance, updates and similar issues, especially in the evening or at night (between 01:00 - 06:00) on days other than working days. In such cases, deductions may be made outside of these days and hours. In this case, the Marketplace will be notified of the details of the emergency and interruption to the Seller as soon as possible.

 

c) iyzico will inform the Seller in advance about the interruption by sending an e-mail message, except in emergencies, in a way that will enable him to take the necessary precautions.

 

d) iyzico does not guarantee uninterrupted access to the Management Interface or uninterrupted operation of the Platform. iYZİ will process the payments on time and will not be responsible for the failure of such transactions due to problems arising from the System Partners, but will endeavor to resolve the said problems as soon as possible and will be in contact with the System Partners.

 

6.3. Protection of Personal Information

 

a) The USER accepts the processing, storage and similar transactions (identifying and recording in the system) by iyzico for the purpose of providing the Service only. The USER accepts that iyzi's servers or units where the data is stored may be abroad, and within this framework, it is possible to export the information about him and the transactions he has made through the Website (to the extent permitted by the legislation). iyzi is aware of the fact that personal data is “confidential information” and that it is obliged to show due diligence to ensure the confidentiality of the personal information given to it for this purpose.

In such a case, iyzico only shares the contact information of the Seller and will not be a party to any commercial relationship to be established between the business partner and the Seller or any dispute that may arise from this relationship.

 

d) The contact information of the USER is used by iyzi only for the purpose of communicating with the USER. Except for the following persons and situations, this information will not be shared with third parties:

 

- iyzi employees,

 

- Third parties assigned by iyzico to process (identify and save in the system) personal information,

 

- Situations necessary for the performance of legal duties.

 

7. COMPLAINT PROCEDURE, LIABILITIES FOR ERRORS AND DAMAGES

 

7.1. COMPLAINT PROCEDURE

 

a) The USER shall inform iyzi about the complaints regarding the services provided by iyzi as follows:

e) The Seller shall not share the complaints submitted by the Buyer regarding the Platform and Payment Transactions with third parties and shall be obliged to verify the complaint. The Seller shall not direct the complaints forwarded to iyzico, unless the problem is caused by the Service, regarding the requests sent directly to it.

 

f) Disputes between the USER and any Buyer or Seller will be resolved between the relevant USER and the Buyer or Seller, who are parties to the transaction, and iyzi will not be responsible for these transactions or disputes. However, in such a case, iyzi will be ready to provide the necessary support to the relevant USER, including providing all kinds of documents and information. If iyzi has to pay a price for any reason (other than its own fault) within the scope of this article, the USER shall immediately indemnify it.

 

g) Complaints will be answered by iyzico within 3 (three) days from the date of receipt.

 

7.2. LIABILITY ARISING FROM ERRORS AND DAMAGES

 

a) iyzi will not participate in the supply or return of the products or services offered on the Website to the Buyer. Therefore, iyzico shall not be liable for the products or services paid for through the Platform, or the fact that the contract between the Buyer and the Seller regarding these paid products or services has been concluded in accordance with the law.

 

b) iyzico is only responsible for direct damages in case of breach of its obligations arising from the Contract, and shall not be liable for damages caused by third parties or System Partners, for which it is not at fault.

 

c) iyzico shall not be liable for the delay in transferring the amounts to the Seller's account due to the situations that occur due to the incomplete or delay of the transactions due to the incorrect or incomplete information entered by the USER after the payment order is given. iyzi will not be liable for any delays that occur as a result of unforeseen or unavoidable circumstances, failure to execute the Payment Transaction, or any errors in the Payment Transaction other than its own fault, or for any damages resulting therefrom.

 

d) In the event that iyzico, its officers, managers and employees suffer a loss or are subject to a legal, administrative or penal sanction due to the USER's breach of any of its commitments or obligations under this Agreement, violating the law or the rights of any third party. Amounts (including attorney's fees) will be recourse to the USER together with its accessories to be paid at the first request, and all related third party requests will be directed to iyzi. iyzi reserves the right to deduct the aforementioned amounts from the payments to be made to the Seller.

 

e) If the Seller violates Articles 4.3.1(f), 7.2(d) and 7.3(h) of this Agreement, he shall be liable to pay a penalty of 25.000 TL to iyzi. iyzico may deduct the penal clause amount from the payments to be made to the Seller. The Seller accepts and declares that iyzico may refuse to pay the amounts due to the Seller under this Agreement in cases defined as risky by iyzico and defined in Articles 4.3.1(f), 7.2(d) and 7.3(h). iyzi reserves the right to claim damages exceeding the amount of the penal clause.
